These are some of the New Hampshire Fish and Game wardens and Attorney General Office officials that were involved in and worked on the Patric McCarthy case.
Left to Right: Asst. Attorney General Jeffrey Strelzin , Col Garabedian, Major Kevin Jordan, Col Jeffery Gray and Captain John Wimsatt of New Hampshire Fish and Game.

Col Garabedien March 23,2011 states the Fish and Game report is accurate as it pertains to Patric McCarthy:
(1) Mission Report Location of Recovery: 2.25 miles up Clearbrook from Rt 112?
Page 9 of 11, signed by Lt Bogardus
“At 1356 hrs, 17 Oct 03 located the victim, location(Coordinates given) West of Clearbrook and 2.2 miles from Place Last Seen (PLS) up stream from foot
Bridge? Can’t be in two places, same distance?
Page 9 of 11, signed Lt Bogardus
At 1356 hrs, The hasty team that located the victim included Team Leader NH F&G Kevin Jordan, and 3 Androscoggin Valley Search and Rescue team members who were
(Cont) Page 10 of 11: Michelle Cormier, Guy Jubinville, Joe Larue. At this time (1356 hrs) notification of the recovery was made by NH State Police Troop F dispatch to the Grafton County Attorney Ricardo St Hilaire and the NH Medical Examiners Office. Assistant Deputy Medical Examiner (ADME non medical) Rosemary Swain authorized removal(1356 hrs)of the victim from the woods based on the remoteness of the location and the investigation by Fish and Game Warden on scene advising the absence of foul Play.
THE DECISION TO REMOVE PATRIC WAS MADE IMMEDIATELY. BY ROSEMARY SWAIN FROM CONCORD, N.H.?
LT SCRENZIA, NHSP CAPE COD TIMES 10/18/03, STATES WITHIN HOURS? HE WAS NEVER CONSULTED.
LT.SCRENZIA, Friday July 31,2009, Interview with George Brennen, Cape Cod Times
“It was a representative of the New Hampshire Fish and Game department who found Patric’s body. (That’s questionable?)
THREE HOURS (3)later,(WE KNOW THAT A LIE)Lt.Screnzia, made the call to rule the death accidental and have the “GAME WARDEN” bring Patric’s body down off the Mountain.
Screnzia said they (who is they?) made the decision after consulting with Fish and Game “Wardens” who routinely handle search and recovery efforts”
I WOULD LIKE THE NAMES OF THE GAME WARDENS HE CONSULTED WITH?
COULD IT HAVE BEEN MARTY GARABEDIEN?
NOTE: HE NEVER MENTIONS THAT HE TALKED TO KEVIN JORDEN? NEVER MENTIONS PHOTO’S?
Page 10 of 11: 1455 hrs litter and other Game Wardens were headed to scene.
1356 hrs Patric found, 1455 hrs so less than an hour the litter is on the way?
At 1659 hrs team begins to carry out Patric. They arrive at 1845 hrs at the Water Tower. (1 hour 46 minutes later.)
WE HAVE 8-10 PEOPLE CARRYING A LITTER DOWN THE MOUNTAIN, AT NO TIME DO THEY STOP TO CHANGE LITTER CARRIERS? OR REST? NO ONE GETS HURT, STRAIGHT SHOT EASY WALK. BECAUSE IF THEY DID STOP AND CHANGE OR REST, THE TIME GETS EVEN LESS TO REACH THE WATER TANK?
Page 10 of 11: 1845 hrs recovery team arrived at the base with the victim in the area of the water tower above the Village of Loon condominiums.
Here Family members met them. The victim was then transported via Fournier Funeral services to their facility in Woodstock, N.H. At the Fournier Funeral Home ADME Rosemary Swain and County Attorney Ricardo St Hilaire examined the body.
SO AGAIN BASED ON THIS ACCURATE REPORT AS YOU CAN READ, NO NHSP WENT TO THE WATER TANK? THEIR WERE NO PHOTO’S SEEN BY ANYONE?
ONE MORE ITEM: N.H. F&G and (S.A.R.) SEARCH AND RESCUE ARE TRAINED IN OTHER STATES WHEN THEY DISCOVER REMAINS, BEFORE PROCEEDING, THEY DETERMINE WHO HAS JURISDICTION? i.e. Local, State, Federal. OF COURSE IN NEW HAMPSHIRE INDIVIDUALS ARE NOT PROPERLY TRAINED. IF THEY WERE THEY WOULD HAVE KNOWN THEY WERE ON “FEDERAL PROPERTY” AND SHOULD HAVE TOUCHED NOTHING.
April 23, 2011 9:23 am
The legal and operational aspects of dealing with a fatality scene begins with the knowledge (Key word KNOWLEDGE) of which particular organization has the investigative authority over the death scene, known in the parlance as the AHJ (agency having jurisdiction) Generally, this will depend on weather the fatality occurred on FEDERAL, state, or privately regulated lands. White Mountains FEDERAL.

July 11, 2009
CONCORD, N.H. — A body recovered on Mount Washington on the evening of July 6, 2009, has been identified as that of Peter Shintani, age 70, of Napanee, Ontario, according to Sgt. Wayne Saunders of the New Hampshire Fish and Game Department.
Hikers had reported finding a body off the Lion’s Head Trail on Mount Washington, the highest peak in New Hampshire’s White Mountains, late Monday afternoon. Personnel from the Mount Washington State Park hiked to the area and confirmed the location of the body, approximately three-quarters of a mile from the top of the mountain. It was a few hundred feet from the trail, hidden from view from the trail or from the air by rocky ledges. Conservation Officers from the N.H. Fish and Game Department, members of the Androscoggin Valley Search and Rescue Team and personnel from the Mount Washington State Park hiked to the location, along with a Medical Examiner and State Police Troop F Detective Sgt. Michael Marshall, who began an investigation at the scene. The body was transported to the summit of Mount Washington and taken down the mountain via the auto road. State Police then sent the body to the State Medical Examiners Office in Concord, N.H., for an autopsy and positive
identification.
September 21, 2011 10:12 am
NOTE: New Hampshire Fish and Game Wardens were never authorized to make the decisions that were made at Patric’s Crime scene, as you can read the above.
Game Wardens are just that Game Wardens. New Hampshire State Police on scene of un attended death?????? New Hampshire Medical Examiner on scene of un attended death???????? They went to the summit?
NO ONE WITH ANY EXPERTISE IN INVESTIGATING? TAKING FORNSIC OR ENTOMOLOGY SAMPLES? NO MEDICAL EXAMINER? EVER WENT TO PATRIC’S CRIME SCENE?
April 30, 2011 10:48 am
Mike Recht, Associated Press, 10/17/2003 – posted at 3:10 p.m.
Col Jeffery Gray – “Gray said Patric apparently died of exposure and said the State Medical Examiner would determine how long he had been dead. He said there was no sign of Foul Play or a fall.”
1:56 p.m. Patric’s body was found
3:10 p.m. Col Jeffery (ESP) Gray 1 hour 14 Minutes after Patric is found Gray made the above comments to the Press. So much for Lt. Screnzia’s story, Cape Cod Times, That he made the decision. Fish and Game made the determination immediately. FBI 2011, Lt (Blank) The Capt made the decission to bring Patric down. The only Captain on site was Marty Garabedian? Do you think he may have called Col Gray before he made the decission? That would explain Col Gray’s comment to Mike Rhett Associated Press.

Cape Cod Times, Tuesday 10 May 2011
“Given the tragedy and depth of emotion for this family, we wanted, and I speak generally of law enforcement, we wanted to track down every possible lead.” Kacavas said. “My view is that was done.”
“Lots of people with 20/20 hindsight can say that’s a crime scene and it should have been treated differently,” Kacavas said. “You have to have knowledge of all the facts of the case.”
The facts of the case are that you never talked to the eye witnesses that saw Patric alive at 1:00 pm (Robbins) 1:40 pm on 13 Oct 03 right in front of the condo. (Nuttoli)
Last month, the Times obtained records of an initial examination of Patric’s body done by deputy medical examiner Rosemary Swain. Her report contradicts the autopsy by Andrew.
In her handwritten report, Swain indicates Patric’s eyes were open, he had “leaves & dirt in eyes, nose, mouth.” She also checked off “petechiae” on her report, an indication of asphyxiation, according to forensic experts.
In the autopsy, Andrew wrote that Patric’s eyes were closed, and there was no mention of leaves on his face and no petechiae was evident.
NOW LETS OPEN THE CASE AND SHAKE THE TREE, DELANEY !!!!!!!
So much for Fish and Game, N.H.S.P. Troop F, running crime scenes in New Hampshire?
July 20, 2011 6:25 am
It appears now from a recent Letter received by me that the following information has been with held for the past 7 years. Col Garabedain now states the following:
(1) At the crime scene were Game Warden Kevin Jordan, + his team of 3 SAR
(2) At the crime scene were Game Warden James Kneeland + his team of 3/4 SAR
(3) At the crime scene were Game Warden John Wimsett + his team of 3/4 SAR
(4) At the crime scene were Other Fish and Game Wardens that he will not release their names as of yet? 3/4?
(5) Also a litter team? 2 ?
(6) at the Water Tank when they bring Patric down are Fournier Funeral Home employees. 3/4?
(7) At the Funeral Home at 7:05 p.m. we have Rosemary Swain ME Office, Sgt Charles West, New Hampshire State Police, Ricardo St Hilaire, Grafton County D.A. AND FUNERAL HOME EMPLOYEES.
We have 24 individuals +/- who have observed Patric at the scene and at the water tank and at the Funeral Home.
IN 7 YEARS NOT ONE OF THE ABOVE TO MY KNOWLEDGE HAS EVER BEEN INTERVIEWED AS TO WHAT THEY OBSERVED. THE ONLY PERSON THAT HAS EVER MADE A COMMENT IN PUBLIC WAS KEVIN JORDAN, WHO STATES ONLY A FEW PEOPLE SAW PATRIC, AND YOU CAN’T RELY ON PHOTO’S. “WELL HE STATES HE TOOK THE PHOTO’S”?
THE NHSP ALSO STATES THEY HAVE NO RECORD OF ANY DISC(2) OR MEMORY CARDS GIVEN TO SGT WEST?
A DOCUMENT WRITTEN AND SIGNED ON 17 OCT 03, STATES THAT PHOTO’S WERE TAKEN BUT THEY WON’T BE AVAILABLE UNTIL SUNDAY?
JUST FOR INFO SGT WEST TIME SHEET STATES HE WAS OFF ON SAT AND SUN, 18 AND 19 OCT 03. SO WHO HAS THE DISC(2)/ MEMORY CARDS? NOT SGT WEST.
I WOULD ON THE OTHER HAND SAY THAT 22 +/- PEOPLE VIEWING PATRIC IS MORE THAN A FEW, YET, IN ALL OF THE INQUIRIES UNDER THE FREEDOM OF INFORMATION ACT FOR THE PAST SEVEN YEARS, AND REQUESTS FOR COPIES OF THE NAMES OF ALL THE PEOPLE AND THEIR INTERVIEWS OF THE 22 +/- PEOPLE, NOT ONE INTERVIEW HAS EVER BEEN MADE AVAILABLE? SO MUSH FOR OUR JUSTICE SYSTEM!

NEW HAMPSHIRE FISH AND GAME – NEWS- SEVEN (7+) YEARS LATER
August 19, 2011 – Col Marty Garabedian: “At 1455 hours, Sergeant James Goss, along with 16 other Fish and Game personnel, started to hike up to Patric’s location with a litter”
“The Game Wardens assisting Seargent Goss are not identified in any reports I have reviewed”
Game Warden’s Kneeland and Wimsatt had four (4) civilian members with them, however, upon review of the report their names are unknown”
So after 7+ years we have Game Warden Jordan and Michelle Cormier, Guy Jubinville, Joe Larue, Game Warden Kneeland with (4) civilians, Game Warder Wimsatt with (4) civilians and Seargent Goss with 16 other Game Wardens at the crime scene.
TOTAL = 31 people at the crime scene. Marty Garabedian wants me to believe that he can only identify (7) by name? The Fish and Game now have 24 people wandering around the crime scene that no one knows by name contaminating the area, and no one cares to get their names?
CONCLUSION: THERE ARE 31 PEOPLE PRESENT PATRIC’S SCENE, ALL EYE WITNESSES. THE ONLY PERSON TO TALK FOR THE PAST 7+ YEARS AS EYE WITNESS IS GAME WARDEN JORDAN?
E-Mail from Goglia, FBI to Wilson, DOJ NH January 06 2008 4:16 PM
Mr. Goglia “since they have been involved from the beginning we think it is extremely important to have at least Chuck (West) present and John (Scarinza) would be a bonus. We certainly want everyone involved from the beginning. The more access we have to information at this meeting the better we can determine what, if anything, should be done going forward” RTK-
(I guess Goglia, FBI considers Thirty (30)eye Witnesses not important in this case?)
E-Mail from Charles West, NHSP to Goglia, FBI, January 10, 2008 8:33 AM
“If you agree I think it may be helpful to have Fish and Game Lt. Kevin Jordan at the meeting next Tuesday. He was the one who found Patric’s body”
(Jordan finding Patric’s body is questionable?)
E-Mail from Goglia, FBI to Charles West, Kirsten Wilson, Cc Maureen Robinson FBI, January 10, 2008 9:54 AM
“Absolutely Lt. Jordan is welcome. He can provide essential first hand information and knowledge” (Well, Goglia, what about the other (30) people that were present with first hand knowledge?)
Con’t Goglia FBI, January 10, 2008 9:54 AM
Here’s some of the things we think should be discussed at Tuesday’s meeting:
Search and recovery of Patric’s body – (31) People at the crime scene? (People invited to meeting, Kirsten Wilson,DOJ NH, NHSP Sgt West never at crime scene, Game Wardan Jordan who I believe did not discover Patric’s body. One of the Civilians with him discovered Patric’s body and Jordan took credit.
All recovery and autopsy photo’s – ALL? Does anyone really know how many photo’s were taken at the crime scene? No one can even tell who got the disc’s? when they were processed? and by who?
Dr. Andrews autopsy report – not mentioned is an earlier report?
Any timelines – New Hampshire has never released their timelines.
(Also no mention of Mr. Ms. Nuttoli or Miwa Robbins eye witnesses to seeing Patric long after Stephen McCarthy says he is missing, and in a completely different location than reported by the NHSP,NH F&G all verified by Gabe’s 140 page interview on 15 Oct 03, by Trooper Rockey and Kimball.)
Max’s (Ms. McCarthy) polygraph – (Which she failed, her answers to the relevant question resulted in deceit according to the examiner she was never re tested?
Photo’s of Max’s vehicle (vehicle is registered to her Husband Stephen McCarthy) RTK-1817
This is the FBI and the New Hampshire Department of Justice conducting the re-investigation of Patric’s death. As you have read their were (31) eye witnesses to the crime scene. They are never mentioned in the 100’s e-mails I have. If you notice Goglia thinks it’s very important to have Sgt West and Lt Scarinza at the meeting, of course they were never present at the crime scene when Patric was found?
E-Mail from Mulvaney, FBI to Sgt Chuck West, Kirsten Wilson
Cc: Goglia, FBI 1/16/2008 12:29 PM
“Chuck/Kirsten, Thanks again for meeting with us yesterday. Your presentation was excellent and very compelling. All of you have done a fantastic job in investigating this unfortunate death”
Note: I have asked for this excellent and very compelling presentation by West and Wilson, and at this time have not received it. RTK-
October 5, 2011 7:16 pm
Interview by FBI of Michelle Cormier confirms that she found Patric’s Body. She stopped 20 feet from the body and alerted other Team Members. Kevin Jordan did not find Patric’s Body, but has taken credit for the past eight years.
